Terms of Use

Agreement
These Terms of Use ("Terms") govern your use of the Polished Edge mobile application ("App") published by Sole Proprietor Artem Danylov (FOP Danylov Artem), Tax ID 3459515134, trading as PG ArtLab ("we", "us").
By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
About the service
Polished Edge is an offline-first tool for scheduling, client management, reminders, and (with PRO) financial tracking and backup.
The App is provided for professional use by solo practitioners. It is not medical software and does not provide medical, legal, or accounting advice.
Financial figures, summaries, and charts are for your convenience only. They are not audited, certified, or guaranteed accurate for tax, accounting, regulatory, or legal reporting. You must verify all figures independently before relying on them.
Eligibility
You must be able to form a binding contract in your jurisdiction. The App is not intended for children.
You are responsible for complying with laws that apply to your business and to personal data you store about your clients.
Acceptable use
You may use the App only for lawful professional purposes and in compliance with applicable laws, including data protection, consumer, and telecommunications rules.
You must not use the App to harass others, send unlawful or unsolicited communications, store unlawful content, or process personal data without a valid legal basis.
You are solely responsible for your relationship with your clients and for any services you provide to them.
License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.
You may not reverse engineer, redistribute, or resell the App except as permitted by law.
Your data
Your business data is stored locally on your device. We do not host it on our servers.
You are solely responsible for the accuracy, security, and backup of your data, including optional iCloud Drive backups and exported .pebackup files.
We are not responsible for data loss caused by device failure, loss, uninstall, iOS updates, or failure to maintain backups.
Reminders and messaging
The App helps you draft reminders and open third-party apps (SMS, phone, Telegram, WhatsApp, Viber, Instagram). We do not send messages on your behalf and do not receive message content.
You are solely responsible for obtaining any consent required before contacting clients, for the content and timing of messages you send, and for compliance with anti-spam, marketing, and telecommunications laws.
PRO subscriptions and purchases
PRO features require a subscription or lifetime purchase through Apple's App Store.
Monthly subscription: PGLabs.Polished_Edge.pro.monthly — auto-renews unless cancelled at least 24 hours before the end of the current period. A 14-day free trial may be offered; trial terms are shown in the App at purchase time.
Lifetime purchase: PGLabs.Polished_Edge.pro — one-time non-consumable unlock.
Payment is charged to your Apple ID. Manage or cancel subscriptions in iOS Settings > Apple ID > Subscriptions.
Use Restore Purchases in the App to recover PRO on a new device signed into the same Apple ID.
Refunds are handled by Apple under App Store policies. We do not process refunds directly.
Apple Standard EULA
For applications made available through the Apple App Store, the following also applies: These Terms are between you and us, not Apple. Apple is not responsible for the App or its content.
Apple has no obligation to provide maintenance or support for the App. Any warranty claims, product claims, or intellectual property claims are our responsibility, not Apple's (within limits required by applicable law).
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
The licensed application is licensed under Apple's standard Licensed Application End User License Agreement (Standard EULA), except where these Terms provide additional or different terms. Apple's Standard EULA is available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
We do not warrant that the App will be uninterrupted, error-free, or meet every use case.
Any reliance on the App for business, scheduling, financial, or client-management decisions is at your sole risk.
Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless us and our operator from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) data you enter, export, back up, or share; (c) your communications with clients or third parties through or in connection with the App; (d) your violation of these Terms or applicable law; or (e) any dispute between you and your clients or third parties.
We may assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with us.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, business opportunities, or goodwill.
We are not liable for missed appointments, business interruption, incorrect financial calculations, actions of Apple or other third-party services (including iCloud, messengers, or carriers), or losses caused by your failure to maintain backups or secure your device.
Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the twelve months before the claim, or USD 50 if you use the free version.
Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the minimum permitted by law.
Dispute resolution
Before starting any court action or formal dispute, you agree to contact us at support@pg-artlab.com and allow at least 30 days for us to try to resolve the issue informally.
Nothing in this section limits mandatory consumer rights that cannot be waived under applicable law.
Governing law
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules.
Disputes shall be subject to the courts of Ukraine at our registered address, unless mandatory consumer protection rules in your country require otherwise.
Changes
We may update these Terms. The effective date at the top of this page will change. Material changes will be posted on this website. Continued use after changes constitutes acceptance.
General
These Terms, together with the Privacy Policy and Apple's applicable terms, are the entire agreement between you and us regarding the App.
If any provision is held invalid, the remaining provisions remain in effect.
Our failure to enforce any right is not a waiver of that right.
You may not assign these Terms without our consent. We may assign them in connection with a reorganisation or sale of our business.
